Rights of entitled person

Entitled person has the right in particular to:

 

  • carry out processing operations with personal data in accordance with the legal basis on which controller processes personal data to the extent and in the manner that is necessary to achieve established and defined purpose of processing in accordance with the PDP Act and other acts, generally binding legal regulations and internal management acts of the controller,
  • be provided with access rights to filing systems of the controller to the extent necessary to fulfil his tasks,
  • be repeatedly instructed provided substantial change occur in his job, service or administrative position, and it caused significant modification in content of the scope of his employment or there was substantial change in conditions of personal data processing or extent of processed personal data within the frame of his job, service or administrative position,
  • violate an obligation to secrecy, as required for the tasks of courts and law enforcement agencies under a special act or in relation to the Office in the performance of its functions; provisions of confidentiality under special acts are not affected,
  • refuse to execute an instruction to process personal data that is inconsistent with generally binding legal regulations or morality.

In the scope of inspection of personal data processing the entitled person has the right in particular to:

  • professional approach from the inspection body during the inspection,
  • the authorization to execute the inspection and to demonstrate its affiliation to the Office before commencing the inspection, in case the entitled person is a statutory body or a person authorized to act on behalf of the statutory body,
  • familiarize himself with the content of the protocol and to appear upon the request of the inspection authority for its discussion, in case the entitled person is a statutory body or a person authorized to act on behalf of the statutory body,
  • file written complains after familiarizing himself with the inspection findings, in case the entitled person is a statutory body or a person authorized to act on behalf of the statutory body,
  • require the fulfillment of the duties of the inspection body during the inspection according to the PDP Act, in case the entitled person is a statutory body or a person authorized to act on behalf of the statutory body.
