National legal framework

Legislation on the protection of personal data at national level based on the general personal law protected by state, fundamental rights and freedoms embodied in the Constitution of the Slovak Republic. Pursuant to its Article 19 (2) and (3) everyone has the right to protection against unauthorized interference in private and family life and to protection against unauthorized collection, publication, or other misuse of personal data.

International legal framework

The upward trend of interest in the issue of privacy occurred mainly in the second half of the 20th century. This increase is mainly due to cash flow, the development of information technology and the need for data stream between cooperating countries, including streams that are carried out through the computer transfers of personal data. There was no legal instrument for a long time at the international level covering the field of personal data protection and neither personal data.

European legal framework

An effort to create one common legal framework and harmonise legislation of personal data protection through the provisions of Community law of the European Union exists at the European level.

 

Primary legislation


The primary law regarding the matter of personal data protection is laid down in:
Article 6 and 39 of the Treaty on the European Union
Article 8 of the Charter of Fundamental Rights of the European Union
Article 16 of the Treaty on the Functioning of the European Union
