Duties of the control body

When performing an inspection, the inspection body is obliged to proceed in such a way that the rights and legally protected interests of the inspected person are not affected. The control body is mandatory.

  • notify the controlled person in advance in writing of the subject of the control; if notification of the control before the start of the control could lead to defeating the purpose of the control or making the control significantly more difficult, the subject of the control may notify immediately before the control,
  • notify in writing the date and time of the inspection at least ten days before the inspection; if the announcement of the start of the inspection could lead to the defeat of the purpose of the inspection or the substantial difficulty of the inspection, it may announce the commencement of the inspection immediately before the inspection,
  • before the start of the inspection and at any time at the request of the inspected person, to prove himself with an authorization to carry out the inspection and a service card (sample 1, sample 2),
  • draw up minutes on the progress of the inspection,
  • draw up an inspection protocol, in which the inspection findings are stated (hereinafter referred to as "the protocol"), or an inspection record,
  • draw up minutes on the submission of an explanation according to § 93 of the Act. j) and § 94 letters. e),
  • hand over to the inspected person one copy of the report on the progress of the inspection, the report on the submission of an explanation, protocol or record of the inspection,
  • to confirm in writing to the inspected person the receipt of original documents or copies of documents, written documents, copies of memory media and other materials and evidence and to ensure their proper protection against their loss, destruction, damage or their misuse,
  • assess the merits of objections to the inspection findings listed in the protocol and take into account the merits of the objections in the appendix to the protocol and inform the inspected person of it,
  • discuss the protocol with the inspected person and make minutes of its discussion.,
