Powers of the control authority

The control body is authorized

  • enter the land and premises of the controlled person, if a permit is not required according to a special regulation,
  • to have access to resources and devices that can serve or serve, or should have served for the processing of personal data by the controlled person,
  • to have access to the data in automated means of processing up to the level of the system administrator, including to the extent necessary to carry out an inspection,
  • verify the identity of natural persons who act on behalf of the inspected person or provide cooperation to the inspection authority,
  • require the inspected person to provide the inspection authority with the original documents or a copy of documents, other documents, statements and information, personal data processed on memory media, including technical carriers of personal data, extracts and source codes of programs, if he owns or has them available to the inspection authority within a specified period in accordance with the conditions of their acquisition, and other materials or documents necessary for the performance of the inspection and, in justified cases, allowed him to take originals or copies even outside the premises of the inspected person,
  • to demand complete and true oral and written information, statements and explanations from the controlled person within a reasonable period of time regarding the controlled facts and facts related to the control,
  • to document evidence related to the performance of the control by making photo documentation, audio recording, video recording or audiovisual recording, even without the consent of the person concerned,
  • also require other cooperation of the inspected person within the scope of the subject of the inspection,
  • to require the provision of cooperation at the place of inspection from a person other than the inspected person, in particular from the intermediary of the inspected person and his employees, or other persons, if there is reason to assume that their activity is related to the subject of the inspection or if it is necessary to clarify the facts related to subject to inspection,
  • to summon at a specified time and to a specified place the inspected person as well as a person other than the inspected person in order to provide an explanation on the subject of the inspection,
  • to carry out joint operations together with the supervisory authorities of other member states according to a special regulation.
Everyone is obliged to provide the office with the necessary cooperation in the performance of its tasks and powers and to enable the office to supervise compliance with obligations under this Act or special regulations and decisions issued on the basis of the Personal Data Protection Act. This does not affect the provisions of § 81 par. 7 and 8.
